terms of use
Can someone link me to the terms of use for these forums?

I'm specifically wondering if any content shared or conversations had may be used as evidence in a court of law, or if specified by the TOU.

This is an extremely vague entry. Is not there a more detailed, less open to interpretation entry available?

Thats what it boils down to. Selling and abusing prescription drugs is widely accepted as illegal. So, is selling prescription drugs here illegal? Yes, but is conversing about abusing them grounds for discipline? Could said conversations be used as evidence in a court of law?

The whole drugs thing was just a generalization. The crime could be of any caliber.

Regarding conversing about them - It depends on the context of the discussion, generally they are confined to the age restricted areas of the forum.

The selling & advertising of them isn't allowed, we (the forum staff) would stamp all over anything like that.

As for being used in a court of law, most courts would throw digital evidence out instantly. What someone writes on a forum isn't necessary accurate, due to that it's not something that could be used.

The moderators are free to discipline you for any actions they deem fit. This does not mean that they can simply rule without consequences. The basic rules are those of netiquette, so whether or not such a conversation would be disciplined would be highly dependent on the exact nature of the conversation. If the conversation was bordering on illegal or such, yes, you could and most likely would be disciplined. If it was actually illegal, you'd likely find yourself banned without a warning.

Could said conversation be used as evidence in a court of law? I'm not sure I would trust evidence from a forum of a few hundred thousand teenagers, but I assume yes, it could be. However, Nabi would likely not be the ones to take you to court for it, due to the incredible expenses in time, money, income, and reputation that it would result in. If others were to take you to court, I assume its use as evidence would be highly circumstantial, but it is certainly a possibility.

I was mostly concerned with the legal aspects of my post, and wondering if Nabi had any policies restricting use of content on its services in a court. It doesn't seem the case. It does seem that digital evidence would be extremely unreliable, and very circumstantial if it was used, depending on the context of the case.

I'm dealing with something a bit crucial right now, and for some reason I believe I'd be more competent than a court-appointed lawyer would . It's probably all paranoia, but that's besides the point. Thanks, again for your advice and info.
